1. Agreement to Terms

By accessing or using Niblit.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and anyone who accesses the Service.

2. Description of Service

Niblit.ai is a platform that allows users to publish and host web applications, portfolios, prototypes, APIs, and other web projects by uploading project files (the "Content"). We provide deployment infrastructure and a public URL for each published project.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account. You may not use another person's account without permission.

You must be at least 13 years of age to use the Service. By creating an account, you represent that you meet this age requirement.

4. User Content and Uploaded Projects

You retain ownership of all Content you upload or publish through the Service. By uploading Content, you grant Niblit.ai a non-exclusive, worldwide, royalty-free license to host, store, process, and serve that Content solely for the purpose of operating and providing the Service.

You are solely responsible for all Content you upload, deploy, or make available through the Service. You represent and warrant that:

  • You own or have the necessary rights and permissions to upload and deploy the Content.
  • The Content does not infringe any third-party intellectual property, privacy, or other rights.
  • The Content complies with all applicable laws and regulations.
  • The Content does not contain malware, viruses, ransomware, spyware, or any other malicious code.

5. Prohibited Content and Uses

You may not use the Service to upload, publish, or deploy Content or applications that:

  • Contain malware, viruses, trojans, spyware, adware, or any other malicious or harmful code.
  • Are designed to attack, compromise, or gain unauthorized access to other systems, networks, or accounts (including phishing pages, credential harvesters, and exploit tools).
  • Violate any applicable local, national, or international law or regulation.
  • Infringe the intellectual property rights, privacy rights, or other rights of any third party.
  • Contain, distribute, or facilitate access to child sexual abuse material (CSAM) or any content that sexually exploits minors.
  • Facilitate illegal activities including but not limited to fraud, money laundering, drug trafficking, or human trafficking.
  • Constitute unsolicited commercial communications (spam) or facilitate spam campaigns.
  • Impersonate any person, entity, or organization, or misrepresent your affiliation with any person or entity.
  • Use excessive computational resources in a manner that degrades service performance for other users (e.g., cryptocurrency mining, denial-of-service tools).
  • Store or process protected health information (PHI) or other regulated personal data without appropriate safeguards and agreements in place.
  • Collect or harvest personally identifiable information without users' explicit, informed consent.

We reserve the right to determine, in our sole discretion, what constitutes a violation of these prohibitions and to take appropriate action, including immediate removal of Content and termination of accounts.

6. Content Moderation and Removal

We reserve the right, but not the obligation, to review, monitor, remove, or disable access to any Content at any time, with or without notice, for any reason including violation of these Terms. We may also report Content or activity to law enforcement authorities where required by law or where we reasonably believe it is necessary to protect the safety of any person.

We are not liable for any failure or delay in removing Content, and we make no representations that we will review all Content.

7. Digital Millennium Copyright Act (DMCA)

We respect intellectual property rights. If you believe Content on our platform infringes your copyright, you may submit a DMCA takedown notice to us at support@niblit.ai with the following information:

  • A description of the copyrighted work you claim has been infringed.
  • The URL or location of the allegedly infringing Content on our platform.
  • Your contact information (name, address, phone number, email).
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner.
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
  • Your physical or electronic signature.

8. Subscriptions and Billing

Certain features of the Service are available only through paid subscription plans. By subscribing, you agree to pay the applicable fees as described on our pricing page. All fees are in US dollars and are non-refundable except as expressly provided in these Terms or required by applicable law.

We may change our pricing at any time. If we change pricing for your existing plan, we will provide at least 30 days' notice before the change takes effect. Your continued use of the Service after a price change constitutes acceptance of the new pricing.

Payments are processed by our third-party payment processor, Stripe. By providing payment information, you also agree to Stripe's terms of service.

We reserve the right to suspend or terminate your account if a payment fails and is not cured within a reasonable period.

9. Service Availability and Resource Limits

We aim to provide reliable service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service (or any part thereof) at any time. Free tier applications may be subject to usage limits, sleep periods, and resource constraints as described on our platform documentation.

We are not liable for any loss or damage arising from service interruptions, downtime, or data loss. You are responsible for maintaining your own backups of your Content and project files.

10. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease and your Content may be deleted.

You may terminate your account at any time by contacting us. Termination does not entitle you to a refund of any prepaid fees.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

WE DO NOT WARRANT OR GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT ON THE SERVICE, AND WE ARE NOT RESPONSIBLE FOR CONTENT UPLOADED OR DEPLOYED BY USERS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIBLIT.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $50.

13. Indemnification

You agree to indemnify, defend, and hold harmless Niblit.ai and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
